Abstract
El presente trabajo de tesis, realizado como opción de grado para optar el título de profesional en Derecho, fue realizado por Luis Carlos Vertel Yánez, bajo la dirección del Dr. Fulgencio Padilla Álvarez, y lleva por título: Derecho al libre desarrollo de la personalidad en los manuales de convivencia de las Instituciones Educativas de Ciénaga de Oro, Córdoba 2015 - 2018 , según la línea jurisprudencial de la Corte Constitucional colombiana . El proyecto fue realizado a lo largo de los períodos académicos del año 2019. El objetivo general de la investigación, fue el de Analizar cómo se garantiza el Derecho al libre desarrollo de la personalidad de los estudiantes, en los manuales de convivencia de las Instituciones Educativas de Ciénaga de Oro, Córdoba, durante el período de 2015 a 2018. Para desarrollarlo, se plantearon los siguientes objetivos específicos: Identificar los aspectos jurídicos a tener en cuenta para garantizar el libre desarrollo de la personalidad de los estudiantes. Caracterizar las situaciones de conflicto que se han podido generar a partir de la vulneración del Derecho al libre desarrollo de la personalidad de los estudiantes de las Instituciones educativas de Ciénaga de Oro, durante el período de 2015 a 2018. Finalmente, determinar las estrategias que se han podido implementar en las instituciones educativas de Ciénaga de Oro, para garantizar el Derecho al libre desarrollo de la personalidad de los estudiantes en los manuales de convivencia, durante el período de 2015 a 2018. El desarrollo de esta investigación, se basó en el estudio de diferentes antecedentes investigativos, directamente relacionados con el tema que a continuación se aborda. Así mismo, se desglosó el marco teórico, a partir de los postulados de la importancia de garantizar los derechos fundamentales como el libre desarrollo de la personalidad, a partir del Derecho a la educación. Así mismo, se definió en marco conceptual y marco legal con base a los cuales se basa y fundamenta este estudio. Por otro lado, respecto al marco metodológico, se resalta que estuvo orientado hacia la población estudiantil de las diferentes instituciones educativas del Municipio de Ciénaga de Oro, esto, por medio de una investigación socio - jurídica, descriptiva, bajo un modelo de enfoque cualitativo. Por otro lado, se desarrollaron los objetivo s específicos, por medio del estudio minucioso de los manuales de convivencia de las Instituciones Edu cativas de Ciénaga de Oro, el análisis de los resultados de las encuestas y entrevistas realizadas, y finalmente, el estudio de las principales líneas jurisprudenciales que, respecto a dicho tema, ha destacado la Corte Constitucional de Colombia. Finalmente, se describen las conclusiones generadas con la realización del proyecto de investigación, así como las recomendaciones propuestas, para garantizar que más allá de los postulados teóricos derivados de los manuales de convivencia, realmente se garantice e n las instituciones educativas estudiadas. This thesis work, carried out as a degree opti on to opt for the title of professional in Law, was carried out by Luis Carlos Vertel Yánez, under the direction of Dr. Fulgencio Padilla Álvarez, and is entitled: Right to free personality development in the coexistence manuals of the Educational Institut ions of Ciénaga de Oro, Córdoba. 2015 - 2018. The project was carried out throughout the academic periods of the year 2019. The general objective of the research was to analyze how the Right to the free development of the personality of the students is guar anteed, in the coexistence manuals of the Educational Institutions of Ciénaga de Oro, Córdoba, during the period from 2015 to 2018. To develop it, the following specific objectives were raised: Identify the legal aspects to be taken into account to guarant ee the free development of the students' personality. Characterize the conflict situations that may have been generated from the violation of the Right to the free development of the personality of the students of the Educational Institutions of Ciénaga de Oro, during the period from 2015 to 2018. Finally, determine the strategies that are they have been able to implement in the educational institutions of Ciénaga de Oro, to guarantee the right to the free development of the personality of the students in t he coexistence manuals, during the period from 2015 to 2018. The development of this research, was based on the study of different research backgrounds, directly related to the subject that is addressed below. Likewise, the theoretical framework was broken down, based on the postulates of the importance of guaranteeing fundamental rights such as the free development of personality, based on the Right to education. Likewise, it was defined in a conceptual framewo rk and legal framework on which this study is based and based. On the other hand, with respect to the methodological framework, it is highlighted that it was oriented towards the student population of the different educational institutions of the Municipal ity of Ciénaga de Oro, this, through a socio - legal, descriptive research, under a qualitative approach model On the other hand, the specific objectives were developed, through a thorough study of the coexistence manuals of the Educational Institutions of C iénaga de Oro, the analysis of the results of the surveys and interviews carried out, and finally, the study of the main lines jurisprudentials that, regarding this issue, has highlighted the Constitutional Court of Colombia.
