La libertad y el debate constitucional colombiano desde Rousseau: ¿hacia una nueva constitución política o hacia el boterismo constitucional?

Abstract
La investigación surge de la tensión entre la noción de libertad como participación activa en la voluntad general, planteada por Rousseau y las limitaciones que se pueden observar en el marco constitucional colombiano vigente, en especial de la Constitución del 91, la cual, pese a sus avances, no ha logrado garantizar un ejercicio real e inclusivo de la ciudadanía en amplios sectores sociales. Como propósito de investigación, se tratará de analizar la libertad en el pensamiento de Rousseau y su aplicación en el contexto colombiano contemporáneo. La metodología empleada es hermenéutica, sustentada mediante un análisis de fuentes primeras, además de literatura secundaria, escritos sobre teoría política y constitucionalismo colombiano. Los autores que se trabajaron fueron los siguientes. Primero: Rousseau, con sus obras, el contrato social y el discurso a la desigualdad de los hombres, su contenido es clave para comprender su propuesta sobre la idea de la libertad. Segundo, Cardona Restrepo, Hernando Valencia Villa, Campo Elías Flores, Abreu Suárez, Cindy Paola y la Corporación Freedom House, quienes ofrecen un contenido teórico que ayuda para la conceptualización de las libertades políticas y civiles en el Estado colombiano. Para finalizar, entre los principales hallazgos que se identifican de la concepción de libertad rousseauniana, se conserva plena vigencia para interpretar la realidad política constitucional en Colombia, en tanto se puede evidenciar la persistencia de desigualdades estructurales, étnicas, económicas y de concentración del poder que restringe la participación ciudadana. Por lo tanto, es relevante poder pensar en el orden constitucional colombiano, sobre todo en clave de soberanía popular, descentralizada y con una justicia social que no se doblegue ante el poder, sino que prime por los derechos de los ciudadanos, teniendo como objetivo la modificación o creación de una nueva carta magna en la que verdaderamente se puedan brindar oportunidades de libertad equidad e inclusión social.

Second, Cardona Restrepo, Hernando Valencia Villa, Campo Elías Flores, Abreu Suárez, Cindy Paola, and the Freedom House Corporation . These authors offer theoretical content that helps conceptualize political and civil liberties in the Colombian state. Finally, among the main findings identified in Rousseaus conception of freedom, It remains fully relevant for interpretation the contit ucional politics in Colombia, while the persistence of structural inequalities can be seen , ethnic, economic and power concentration inequalities that restrict citizen participatión. Therefore, it is importannt to consider the colombiano constitutional orden, especially, in with a terms of popular sovereignty , decentralization and social justicia that does not bow to power but rather prioritizes the rights of citizens, with the objective of modifying or creating a new Constitution that truly provides opportunities for freedom, equity, and social inclusion.
