Protección de los derechos humanos de los migrantes en el Tapón del Darién: Instituciones y mecanismos

Abstract

El artículo analiza los mecanismos e instituciones nacionales e internacionales para la protección de los derechos humanos de los migrantes en el Tapón del Darién, una de las rutas más peligrosas de América, y su efectividad en prevenir violaciones a estos . La investigación, con enfoque cualitativo y crítico - social, se basa en la revisión de doctrina, jurisprudencia y normativas. A nivel nacional, Colombia expide salvoconductos y cuenta con herramientas legales como la tutela y el derecho de petición, mient ras que Panamá ha creado centros de acogida y regulaciones migratorias, en el ámbito internacional, organismos como la ONU, la CIDH y la OIM han impulsado políticas de protección, junto con ONG como Médicos Sin Fronteras y ACNUR. Pese a la existencia de no rmativas y cooperación, persisten brechas en su implementación, se identifican desafíos como la falta de coordinación entre Colombia y Panamá, la ausencia de registros de migrantes, la violencia, el tráfico de personas y la explotación. Se concluye con rec omendaciones para mejorar la protección, incluyendo protocolos de seguridad más eficaces, capacitación de funcionarios y sistemas de monitoreo y registro de migrantes para una mejor respuesta ante la crisis humanitaria.The article analyzes national and international mechanisms and institutions for the protection of migrants' human rights in the Darién Gap, one of the most dangerous migration routes in the Americas, and their effectiveness in preventing violations. The research, with a qualitative and critical - social approach, is based on the review of doctrines, jurisprudence, and regulations. At the national level, Colombia issues safe - conduct permits and has legal tools such as tutela and the right to petition, while Panama has established recept ion centers and migration regulations. At the international level, organizations such as the UN, the IACHR, and the IOM have promoted protection policies, alongside NGOs like Doctors Without Borders and UNHCR. Despite existing regulations and cooperation, implementation gaps persist. Challenges include a lack of coordination between Colombia and Panama, the absence of migrant records, violence, human trafficking, and exploitation. The article concludes with recommendations to improve protection, including m ore effective security protocols, training for officials, and monitoring and registration systems to enhance the response to the humanitarian crisis.
