Abstract
La intersección entre la inteligencia artificial, en adelante (I.A.), y el derecho penal aborda un debate esencial sobre sus implicaciones éticas y legales. Su capacidad para incrementar la eficiencia judicial es evidente; no obstante, surgen preocupaciones como la transparencia, alucinaciones, la privacidad y el sesgo algorítmico. Abordar estas cuestiones es esencial para garantizar un sistema legal justo y transparente, especialmente dado que la I.A. ya se utiliza formalmente en instituciones como la Corte Constitucional, la Fiscalía General de la Nación, y de manera informal por jueces, magistrados, estudiantes y usuarios del sistema penal. Para comprender el impacto de la I.A. en el derecho penal, es necesario definir esta herramienta tecnológica, explorar su potencial, estudiar sus inicios y evolución hasta la actualidad. Además, se deben considerar las implicaciones éticas, limitaciones, riesgos y peligros de su uso. Es crucial ofrecer un contexto real de la I.A. para entender cómo transformarla en una aliada en lugar de oponerse a su implementación.
The intersection between Artificial Intelligence (AI) and criminal law addresses a crucial debate about its ethical and legal implications. Its potential to increase judicial efficiency is evident; however, concerns arise regarding transparency, hallucinations, privacy, and algorithmic bias. Addressing these issues is essential to guaranteeing a fair and transparent legal system, especially given that AI is already formally used in institutions such as the Constitutional Court, the Attorney General's Office, and informally by judges, magistrates, students, and users of the criminal justice system. To understand the impact of AI on criminal law, it is necessary to define this technological tool, explore its potential, and study its beginnings and evolution to the present. Additionally, ethical implications, limitations, risks, and dangers of its use must be considered. It is crucial to offer a real context of AI to understand how to transform it into an ally instead of opposing its implementation.
