Abstract
El Sistema de Justicia Penal Juvenil en Colombia está enmarcado en la Ley 1098 de 2006 ( Ley de Infancia y Adolescencia ) , fundamentada en la justicia restaurativa que propende por la protección del menor infractor, el restablecimiento de sus derechos, la resocialización, la reincorporación a la familia y al sistema de educativo ;en este sistem a diferencial todos los niños, niñas y adolescentes son inimputables , lo que hace sean más propensos a la instrumentalización como consecuencia de su vulnerabili dad. De esto modo, la pretensión investigativa , la cual es de tipo cualitativo con un enfoque s ocio jurídico y usando la técnica de recolección documental , es determinar las principales barreras y desafíos, tanto a nivel legal como social que se cuestionan sobre el mencionado sistema frente a la inimputabilidad de los menores en la comisión conducta s punibles, a través de la instrumentalización ; dando como resultado la creciente participación en hechos delictivos por el desacierto de las instituciones funda mentales como la familia, la sociedad y el Estado . Se concluye, entre otras, como l a familia y la escuela son las instituciones por excelencia creadas por la sociedad como protectoras de los menores de edad, y con el fallo en su rol protector de vincularlos en ambientes familiares saludables , con una escolarización dirigida y segura, estas mismas in stituciones se convierten en factores de riesgo para ellos.
The juvenile criminal justice system in Colombia is framed by Law 1098 o f 2006 (Law of Children and Adolescents), based on restorative justice that aims at the protection of juvenile offenders, the restoration of their rights, resocialization, reintegration into the family and the education system. In this differential system, all children and adolescents are not unchanging, which makes them more prone to instrumentalization as a result of their vulnerability. In this way, the investi gative aim, which is qualitative with a socio - legal approach and using the technique of documen tary collection, is to determine the main barriers and challenges, both at the legal and social levels, that are questioned about the previously mentioned system in the face of the imputability of minors in the commission of punishable conducts. through i nstrumentalization; resulting in the growing participation in criminal acts due to the failure of fundamental institutions such as the family, society and the St ate. It is concluded, among others, that the family and the school are the institutions par exc ellence created by society as protectors of minors, and with the failure in their protective role of linking them in healthy family environments, with a directed and safe schooling, these same institutions become risk factors for them.
